Terms of Service.

These terms govern your use of Transmit. By using the service you agree to them, so please read them.

Acceptance of terms

By accessing or using Transmit (the "Service"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, you may not use the Service.

Eligibility

  • You must be at least 18 years of age to use the Service.
  • If you use the Service on behalf of an organization, you must have the legal authority to bind that organization to these Terms.
  • You represent that all information you provide is accurate and complete.

The service

Transmit provides message delivery through its platform and API:

  • Transactional and broadcast email delivery, delivery analytics, and domain authentication (SPF, DKIM, DMARC).
  • Transactional SMS, where enabled for your account: one-time codes, account and delivery notifications, and support replies, sent from approved templates with A2P 10DLC compliance. No marketing SMS and no free-text message bodies.

The API is compatible with the Resend and SendGrid request specifications for ease of migration.

Your account

To use Transmit you must create an account and keep a valid payment method on file. When you register, you agree to:

  • Provide accurate, current, and complete information, and keep it updated.
  • Keep your credentials and API keys confidential.
  • Accept responsibility for all activity under your account.
  • Notify us immediately of any unauthorized use of your account.

One organization and one verified sending domain per account. If you need more, write to support@transmit.dev.

Fees, credits, and refunds

The Service has a platform fee of $9 per month, billed to the payment method on file, plus credits that are consumed when messages are sent. The current credit price and the minimum purchase are published on the pricing page.

Credits

  • Purchased credits do not expire while your account is in good standing.
  • If the platform fee lapses, sending pauses. Your credit balance stays on the account and sending resumes when the subscription is active again.
  • Trial credits are granted after domain verification and may be withdrawn if the account is terminated for a violation of these Terms.
  • Your credit balance is visible in your dashboard at all times.
  • Credits are non-transferable between accounts.
  • Pricing is subject to change with 30 days advance notice.
  • Payments are processed by Stripe.

Refunds

Credit purchases are final once usage begins. We recommend starting with the minimum purchase to test the Service before buying more. Platform fees already billed are not refunded.

If Transmit issues a refund on account closure, at its sole discretion: promotional and trial credits are excluded from the calculation; discounted credits are refunded at the published rate, not the discounted rate; and the refund is calculated at the published rate at the time of purchase or as of the current date, whichever yields more to you.

Third-party providers

Transmit relies on third-party infrastructure providers, including AWS SES and Telnyx, to deliver your messages.

Transmit is not responsible or liable for credits, refunds, or reimbursements if a third-party provider ceases sending for your account, domain, or phone number for any reason. Providers may suspend or terminate sending at their discretion under their own policies, compliance requirements, and abuse detection. Provider decisions on account status, deliverability, and policy enforcement are final.

We will work with providers on your behalf so long as you meet their requirements, assist with appeals when appropriate, and provide guidance on staying in good standing.

Acceptable use

You agree to use Transmit only for lawful purposes and in compliance with these Terms.

You must

  • Send only to recipients who have opted in to hear from you.
  • Identify yourself accurately as the sender.
  • Honor unsubscribe requests promptly.
  • Keep proper consent records.
  • Comply with all applicable laws.

You must not

  • Send spam or unsolicited messages.
  • Engage in phishing or fraud.
  • Distribute malware or harmful content.
  • Send to purchased, rented, or scraped lists.
  • Send unlawful or prohibited content.
  • Register additional accounts, domains, or payment identities to evade screening, limits, or a suspension.

Sending unlawful messages or content, or evading screening, may result in immediate termination and forfeiture of all remaining credits without refund.

Your legal obligations

You must comply with all laws that apply to your messages, including CAN-SPAM, TCPA, GDPR, CASL, and CCPA where applicable. In particular:

  • Maintain consent records for all recipients.
  • Honor unsubscribe and opt-out requests within the legally required time.
  • Provide accurate sender identification and required disclosures, including a physical address where applicable.
  • Respond to data subject requests as privacy law requires.

You are solely responsible for understanding and complying with the laws that apply to your use case, industry, and your recipients' locations.

Indemnification

You agree to hold Transmit.dev, its parents, partners, subsidiaries, affiliates, officers, directors, employees, and agents harmless from any claims, damages, losses, or expenses arising from:

  • Your violation of these Terms.
  • Your violation of any law, regulation, or third-party right.
  • Your content, messages, or messaging practices.
  • Third-party claims related to your use of the Service, including claims from recipients of your messages.

This obligation survives termination of your account and of these Terms.

Limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We make no guarantee of message deliverability, of specific delivery times, of inbox placement, or of uninterrupted service.

Transmit is not liable for indirect or consequential damages, lost profits or revenue, lost data, business interruption, or punitive or exemplary damages. In no event shall Transmit's total liability exceed the fees you paid to Transmit in the 12 months before the claim.

Termination

By Transmit

We may suspend or terminate your account for a violation of these Terms or the acceptable use policy, fraudulent or illegal activity, non-payment, or extended inactivity.

By you

You may close your account at any time from the dashboard or by writing to support@transmit.dev.

Effect

  • API access is revoked immediately.
  • Remaining credits are forfeited and non-refundable, except as described under refunds above.
  • Your data is deleted on the schedule in the Privacy Policy.

Changes to these terms

When we make material changes we will give at least 30 days notice by email to your registered address, and post the updated Terms here with a new date. Continued use after the effective date is acceptance of the modified Terms. If you do not agree, stop using the Service and close your account.

Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions. Transmit.dev is a service of WeWill3C, LLC, a Texas limited liability company.

  1. You agree to first try to resolve any dispute informally by contacting us.
  2. If that fails, disputes are resolved through binding arbitration.
  3. You waive any right to participate in a class action.
